Personal Data

1. Collection and use of Personal Data

1.1 Data collected

Our company receives your personal data if they are provided in any way (e.g. communication via email).

If you choose to register or log in to our website using a third-party single sign-up service that authenticates your identity and links your social media login information (e.g. LinkedIn, Facebook, Google or Twitter) to ARCHON YACHTING, we collect any information or content needed for registration or login, for which you have given the social media provider permission to share it with us;  such as your name and email address. The collection of other information may depend on the privacy settings you have set with the social media provider, so please read the privacy statement or policy of the relevant service and provider.

By registering and/or submitting your personal data to ARCHON YACHTINGG, you also consent to the use of such data in accordance with this Statement. Your personal data is not used for other purposes unless we obtain your permission, or unless required or permitted by law or professional standards.

1.2 The legal basis for the use of your personal data.

ARCHON YACHTING generally collects only personal data that is necessary to satisfy your requests. Where additional, optional information is sought, you will be informed at the time of data collection.

Greek and EU legislation allows us to process personal data, provided we have the reason and the legal basis to do so. We are also required to notify you of the reason and the legal basis for processing. As a result, when we process your personal data, we rely on one of the following lawful processing cases:

  • Performance of a contract: this occurs when the processing of your personal data is necessary for the performance of our obligations arising from a contract.

  • Legal obligation: this is when we are required to process your personal data to comply with a legal obligation, such as keeping records for tax purposes or providing information to a public body or law enforcement authority.

  • Legitimate interest: we may process data about you when we have a legitimate interest in performing a lawful activity in order to ensure the continuity of that activity, to the extent that our legitimate interest does not outweigh and does not conflict with your interests, or

  • Your consent: we may occasionally ask you for explicit consent to process some of your personal data, and your personal data will only be processed in this way if you agree to this. You can withdraw your consent at any time by contacting KPMG at [email protected].

ARCHON YACHTING collects special category personal data only when such individuals voluntarily send us such data in their own interest or when such data is required or their collection is permitted by law or professional standards. The concept of special category personal data includes personal data concerning a person's race, nationality, political opinions, trade union membership, religious or similar beliefs, physical or mental health, sex life or criminal record. Please do not provide us with special category data unless it serves your own interest and you consent to their use by the company for lawful purposes and to the transmission and storage of such data to and in ARCHON YACHTING databases.

1.3 Automatic collection of Personal Data

In some cases, ARCHON YACHTING and its service providers use cookies, web beacons and other technologies to automatically collect certain categories of data when you visit us online, as well as through emails we may exchange. The collection of this data allows us to personalize your online experience, improve the performance, usability and effectiveness of ARCHON YACHTING's online presence and measure the effectiveness of our marketing activities.

1.3.1 IP addresses

An IP address is a number assigned to your computer each time you access the internet. It allows computers and servers to identify and communicate with each other. The IP addresses from which visitors appear to originate may be recorded for information technology security and system diagnostics purposes. This data may also be used in aggregate form in order to perform an analysis of website trends and performance.

1.3.2 Cookies

Cookies may be placed on your computer or internet-enabled device each time you visit us online. This allows the website to remember your computer or device and serve more purposes.

Below is a list of the types of cookies we use on our websites.

Other third-party tools and widgets may be used on our individual websites to provide additional functionality. The use of these tools or widgets may install a cookie on your device to make their service easier to use, and to ensure that your activity is displayed correctly on our websites.

Cookies alone do not tell us your email address or identify you personally in any other way. In our analytical reports, we may receive identifying information including IP addresses, but only to determine the number of unique visitors to our websites and the geographic origin of visitors, and not to identify individual visitors.

1.3.3 Google Analytics

ARCHON YACHTING uses Google Analytics. More information on how KPMG uses Google Analytics can be found here: http://www.google.com/analytics/learn/privacy.html

In order to provide website visitors with more options on how Google Analytics collects their data, Google has developed the Google Analytics Opt-out Browser Add-on. The add-on communicates with the Google Analytics JavaScript (ga. js) to indicate that information about the visit to the website should not be sent to Google Analytics. The Google Analytics Opt-out Browser Add-on does not prevent information from being sent to the website itself or to other web analytics services.

 1.3.4 Web beacons

A web beacon is a small image file on a website that can be used to collect certain data from your computer, such as IP addresses, the time at which the content of the website was viewed, the type of browser, and the existence of cookies previously placed by the same server. ARCHON YACHTING uses web beacons only in accordance with the provisions of applicable law.

ARCHON YACHTING or ARCHON YACHTING service providers may use web beacons to track the effectiveness of third-party websites that provide us with recruitment or advertising services, or to collect aggregate visitor statistics and manage cookies.

You have the option to make some web beacons inactive by rejecting the relevant cookies. The web beacon will still be able to record an anonymous visit from your IP address, but cookie information will not be recorded.

1.3.5 Location-based tools

ARCHON YACHTING may collect and use the geographic location of your computer or mobile device. This location data is collected for the purpose of providing you with information about services that we believe may be of interest to you based on your geographic location, as well as to improve our location-based products and services.

1.4 Social media apps and widgets

ARCHON YACHTING's websites may include functionality so that you can share through third-party social networking applications, such as the Facebook Like button and Twitter widget. These social networking applications may collect and use information about your use of ARCHON YACHTING websites. Any personal information you provide through such social media applications may be collected and used by other members of such social networking application and such exchanges are governed by the privacy policies of the companies providing the application. We have no control over or responsibility for these companies or their use of your information.

In addition, the ARCHON YACHTING website may host blogs, forums, crowd-sourcing and other applications or services (collectively referred to as "social media features"). The purpose of social media features is to facilitate the exchange of information and content. Any personal information you provide on any ARCHON YACHTING social media feature may be disclosed to other users of that social media feature (unless otherwise stated at the collection stage), over whom we may have limited or no control.

The publication of personal data of third parties (images, etc.) through ARCHON YACHTING websites is unlawful, unless prior consent has been obtained from the data subjects.

1.5 Children

ARCHON YACHTING understands the importance of protecting children's personal data, especially in an online environment. In particular, our websites are neither intentionally designed nor directed at children under the age of 13. Our policy is never to knowingly collect or keep data about any person under the age of 13.

2. Disclosure and transfer of Personal Data to third parties

We do not share personal data with third parties who are not affiliated with us, unless this is required for our legitimate professional and business needs, in order to respond to your requests and/or if required or permitted by law or professional standards.

This includes:

  • Our service providers: ARCHON YACHTING works with trusted partners, service providers or organizations that can process your personal data on our behalf. ARCHON YACHTING transmits personal data to them only when they meet our strict data processing and security standards. We only disclose personal data that allows them to provide their services.

  • In case of our reorganization or sale to another organization: ARCHON YACHTING may also disclose personal data relating to the sale, assignment or other transfer of the business of the website to which the data relates.

  • Courts, judicial authorities, law enforcement or regulatory authorities: ARCHON YACHTING may disclose personal data in order to respond to requests from courts, judicial authorities, governmental or law enforcement authorities or where it is required or prudent to comply with applicable law, court decisions or rules, or orders of courts or judicial authorities.

  • Audits: disclosures of personal data may also be required for privacy and security audits and/or to investigate or respond to a complaint or security threat.

ARCHON YACHTING will not transmit the personal data you provide to any third parties for their own direct use for marketing purposes.

3. Options

As a general rule, you are not required to submit personal data to ARCHON YACHTING online, but we may ask you to provide certain personal data in order to receive additional information about our services and events. ARCHON YACHTING may also ask for your consent to certain uses of your personal data and you can either consent to or refuse these uses. If you accept the consent clause for specific services or communications, such as an electronic newsletter, you will be able to unsubscribe from the relevant mailing list at any time by following the instructions contained in each communication. If you decide to unsubscribe from a service or communication, we will delete your data in accordance with the law, although we may need some time and/or information before we can satisfy your request by informing you in advance.

As mentioned above in the "Cookies" section, if you wish to avoid being tracked by cookies as you browse our websites, you can set your browser to reject all cookies or to notify you when a cookie is being sent. Please note, however, that some parts of our websites may not function properly if you choose to refuse cookies.

4. Access

If you have submitted personal data to ARCHON YACHTING, you have the following rights:

  • Information, Access and Correction/Deletion: you have the right to access this data. This is sometimes referred to as a "Subject Access Request". If we agree that we are obliged to provide you with personal data, we will provide it to you free of charge. Before providing you with personal data, we may ask you for proof of your identity and sufficient information about your transactions with us from which we can identify your personal data data. If the data we hold about you is inaccurate, you can ask us to correct any inaccuracies in the personal data, even delete them, as long as the deletion does not contravene our legal obligation.

  • Limitation of purpose/Objection to processing: you have the right to object to the processing of your personal data by us if we no longer have the right to use them, to request that they be deleted if they have been in our records for a long time or to request that their processing be restricted in certain cases.

You can make a request or exercise these rights by contacting [email protected] and we will make all reasonable and practical efforts to comply with your request, provided it complies with applicable law and professional standards.

5. Data Security, Personal Data Breaches, Storage, Retention Time and Data Integrity

ARCHON YACHTING implements security policies and procedures in order to protect personal data and information from unauthorized loss, misuse, alteration or destruction. Despite KPMG's efforts, absolute security cannot be guaranteed against every threat. In case of loss or breach of personal data we have a specialized incident response team and a procedure to deal with these incidents in order to remedy the breach as soon as possible, limit the possible consequences and comply with our obligations under the law. Access to your personal data is limited to those who need to know them. The persons who have access to the data are obliged to maintain their confidentiality.

We also make every effort to keep the personal data we collect from you only for the period for which we need such data for the purpose for which they were collected or to comply with the request of each individual or until their deletion is requested by the subject (and in any case not more than 10 years,  unless we continue to comply with them as provided for in applicable law).

6. Links to other websites

Please note that the ARCHON YACHTING website may contain links to other websites, including those maintained by other ARCHON YACHTING member companies and governed by other Data Protection Policies, the content of which may differ from this Data Protection Policy. Please review the Data Protection Policy of each website you visit before disclosing any personal data.

However, ARCHON YACHTING complies with its obligations arising from the applicable Greek and European legislation on the protection of personal data, as in force, and the applicable regulatory directives related to the management of personal data.

8. Changes to this Statement

ARCHON YACHTING may periodically update this Policy to reflect developments in Personal Data Protection.
